Terms of Service for OneVine

1. Agreement to Terms

Welcome to OneVine ("we," "our," "us," or "the App"). OneVine is a spiritual growth and community engagement application operated by Lysara LLC.

By accessing or using the OneVine mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date and posting a notice in the App. Your continued use of OneVine after such changes constitutes your acceptance of the new Terms.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years old to use OneVine. By using the App, you represent and warrant that you are at least 13 years of age. If we learn that a user is under 13, we will terminate their account immediately.

2.2 Geographic Restrictions

OneVine is available worldwide, but certain features may be restricted based on your location. You are responsible for complying with local laws in your jurisdiction.

2.3 Account Capacity

You represent that you have the legal capacity to enter into these Terms. If you are using OneVine on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

3.1 Account Creation

To use certain features of OneVine, you must create an account by providing:

• A valid email address
• A secure password
• A username
• Your birthdate (for age verification)
• Optional profile information

3.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.4 One Account Per Person

You may only create and maintain one account. Multiple accounts by the same person are prohibited.

4. User Responsibilities and Conduct

4.1 Acceptable Use

You agree to use OneVine only for lawful purposes and in accordance with these Terms. You agree NOT to:

Prohibited Content:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Post content that promotes hate speech, discrimination, or violence
• Share sexually explicit or pornographic content
• Post content that infringes on intellectual property rights of others
• Share false, misleading, or deceptive information
• Post spam, advertising, or promotional content without authorization

Prohibited Activities:

• Impersonate any person or entity
• Harass, stalk, or harm other users
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any part of the App
• Use automated systems (bots, scrapers) without permission
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Use the App for any commercial purpose without authorization
• Engage in any activity that could damage, disable, or impair the App

Spiritual Content Guidelines:

• Respect all religious and spiritual traditions
• Engage in constructive and respectful dialogue
• Do not misrepresent religious teachings or practices
• Do not use the App to recruit for religious organizations without permission

4.2 User-Generated Content

You are solely responsible for all content you submit, post, or share through OneVine, including:

• Journal entries
• Chat conversations
• Challenge proofs and captions
• Confessional content
• Messages to organizations
• Profile information

4.3 Content Ownership

You retain ownership of content you create. However, by posting content on OneVine, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of operating and improving the App.

We do not claim ownership of your personal spiritual content, journals, or reflections.

5. Subscriptions and Payments

5.1 Subscription Plans

Free Tier:

• Limited daily challenges (1 free ask/skip per day)
• Temporary chat storage
• No journal or confessional access
• No course access

OneVine+ Subscription:

• Unlimited daily challenges
• Persistent chat history
• Journal and confessional access
• Full course access
• Token usage for AI interactions
• Ad-free experience
• Price: $9.99/month (or as displayed in the App)

Organization Plans:

• Base Plan: For small teams and communities
• Plus Plan: For larger organizations with advanced features
• Pricing displayed in the App

5.2 Billing and Payment

Automatic Renewal:

• Subscriptions automatically renew at the end of each billing period unless cancelled
• Your payment method will be charged automatically

Payment Processing:

• All payments are processed securely by Stripe, our third-party payment processor
• We do not store your credit card information
• You must provide valid payment information to subscribe

Price Changes:

• We may change subscription prices at any time
• Price changes will be communicated at least 30 days in advance
• Price changes take effect at your next renewal
• If you do not agree to a price change, you may cancel your subscription

Taxes:

• Prices do not include applicable taxes
• You are responsible for all taxes associated with your subscription

5.3 Cancellation and Refunds

How to Cancel:

• You may cancel your subscription at any time through the App settings
• Cancellation takes effect at the end of your current billing period
• You will retain access to subscription features until the end of the paid period

Refund Policy:

• Subscriptions are non-refundable except as required by law
• We do not provide refunds or credits for partial subscription periods
• If you believe you were charged in error, contact us at info@lysaratech.com
• Refunds for purchases made through app stores (Apple App Store, Google Play) are subject to those platforms' refund policies

Free Trials:

• If we offer a free trial, you will be charged when the trial period ends unless you cancel before that time
• We will notify you before charging for the first paid period

5.4 Token Purchases

Tokens:

• Tokens are virtual currency used for AI interactions and features
• Tokens can be purchased in packs: 20, 50, or 100 tokens
• Token purchases are final and non-refundable
• Tokens do not expire while your account is active
• Tokens have no cash value and cannot be exchanged for cash

5.5 Donations

Charitable Giving:

• OneVine facilitates donations to support the platform
• Donations are optional and non-refundable
• Donation amounts: $2, $5, $10, or custom amounts
• Donations may be made anonymously or publicly
• We do not guarantee tax-deductible status; consult your tax advisor

6. AI-Generated Content and Disclaimers

6.1 AI Services

OneVine uses Google Gemini API to provide:

• Daily challenge explanations
• Spiritual guidance and reflections
• Journal assistance
• Confessional conversations
• Quiz and assessment content
• Personalized recommendations

6.2 AI Content Disclaimer

IMPORTANT: AI-generated content is provided for informational and educational purposes only. It is NOT:

• Professional religious or spiritual advice
• Mental health counseling or therapy
• Medical advice or treatment
• Legal advice
• Financial advice
• A substitute for professional guidance

Limitations:

• AI responses may be inaccurate, incomplete, or inappropriate
• AI does not have personal beliefs, emotions, or spiritual understanding
• AI cannot replace human religious leaders, counselors, or therapists
• AI may generate responses that conflict with specific religious teachings

Your Responsibility:

• You use AI features at your own risk and discretion
• Always verify AI-generated information with trusted sources
• Consult qualified professionals for serious spiritual, mental health, or personal matters
• Do not rely solely on AI for important life decisions

6.3 Crisis Situations

OneVine is NOT a crisis service. If you are experiencing a mental health emergency, suicidal thoughts, or immediate danger:

7. Intellectual Property Rights

7.1 OneVine Ownership

We Own:

• The OneVine app, website, and all related technology
• All logos, trademarks, service marks, and trade names
• All content we create (courses, lessons, original challenges)
• The app's design, layout, and user interface
• All software, code, algorithms, and technology

You May NOT:

• Copy, modify, or distribute our proprietary content
• Use our trademarks without written permission
• Create derivative works based on OneVine
• Sell, license, or commercialize any part of the App

7.2 Your Content

You Own:

• Your journal entries and personal reflections
• Your chat conversations and messages
• Your challenge proofs and photos
• Your profile information and submissions

License You Grant Us:

By posting content on OneVine, you grant us a non-exclusive, worldwide, royalty-free license to:

• Store and display your content in the App
• Use your content to improve our services
• Display your username and points on leaderboards
• Show your challenge proofs to organization administrators (if applicable)

This license ends when you delete your content or account, except for content that has been shared or is needed for legal compliance.

7.3 Feedback and Suggestions

If you provide feedback, suggestions, or ideas about OneVine:

• We may use them without obligation or compensation to you
• You grant us all rights to use and implement your feedback
• You waive any claims related to our use of your feedback

8. Organization Features

8.1 Creating an Organization

If you create an organization on OneVine:

• You become the organization leader with full administrative rights
• You are responsible for managing members and content
• You must ensure your organization complies with these Terms
• You may appoint admins to help manage the organization

8.2 Joining an Organization

When you join an organization:

• Your display name, points, and activity may be visible to leaders and admins
• You agree to follow the organization's rules and guidelines
• You can leave at any time through the App settings
• Leaders/admins may remove you from the organization

8.3 Organization Conduct

Organizations must NOT:

• Promote hate speech, discrimination, or violence
• Engage in illegal activities
• Harass or abuse members
• Misrepresent their purpose or affiliation
• Use the organization for commercial purposes without authorization

We reserve the right to remove organizations that violate these Terms.

9. Privacy and Data

9.1 Privacy Policy

Your use of OneVine is also governed by our Privacy Policy, available at:

By using OneVine, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.

9.2 Your Data Rights

You have the right to:

• Access your personal data
• Export your data (Settings → Export My Data)
• Correct inaccurate information
• Delete your account and data (Settings → Delete Account)
• Opt out of analytics tracking

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

• Using the "Delete Account" feature in Settings
• Contacting us at info@lysaratech.com

Upon termination:

• Your account will be deactivated immediately
• Your data will be permanently deleted within 30 days
• Active subscriptions will be cancelled (no refund for partial periods)

10.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in illegal activity
• You abuse or harass other users
• You attempt to harm or disrupt the App
• We are required to do so by law
• Your account remains inactive for an extended period

Effects of Termination:

• You lose access to all features and content
• We may delete your data
• You remain liable for any outstanding payments
• Provisions that should survive termination will remain in effect

11. Disclaimers and Limitation of Liability

11.1 "AS IS" Disclaimer

ONEVINE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free service

11.2 No Guarantee of Results

We do not guarantee that:

• OneVine will meet your spiritual, personal, or religious needs
• The App will be available at all times or function without errors
• AI-generated content will be accurate, appropriate, or helpful
• Your use of OneVine will lead to any particular outcome
• Content will be free from viruses or harmful components

11.3 Third-Party Services

We rely on third-party services (Firebase, Stripe, Google Gemini) and are not responsible for:

• Their availability or performance
• Changes to their services or policies
• Data breaches or security issues on their platforms
• Your interactions with third-party services

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We Are NOT Liable For:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use OneVine
• Damages resulting from AI-generated content or advice
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party on the App

Our Maximum Liability:

In no event will our total liability to you for all claims exceed the greater of:

• $100 USD, or
• The amount you paid us in the 12 months before the claim arose

11.5 State Law Rights

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless OneVine, Lysara LLC, and our officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of OneVine
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your content posted on OneVine
• Your breach of any representation or warranty in these Terms
• Any activity conducted through your account

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to contact us at info@lysaratech.com and attempt to resolve the dispute informally. Provide:

• Your name and contact information
• A description of the dispute
• Your desired resolution

We will attempt to resolve the dispute within 30 days.

13.2 Binding Arbitration

Agreement to Arbitrate:

If informal resolution fails, you and OneVine agree to resolve disputes through binding arbitration instead of in court, except for:

• Small claims court disputes (under jurisdictional limits)
• Intellectual property disputes
• Claims for injunctive or equitable relief

Arbitration Rules:

• Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• The arbitrator's decision is final and binding
• Each party pays their own attorney's fees unless the arbitrator rules otherwise

13.3 Class Action Waiver

You and OneVine agree that:

• Disputes will be resolved individually, not as a class action
• You waive your right to participate in a class action lawsuit
• You waive your right to a jury trial
• Arbitration will be conducted on an individual basis only

13.4 Opt-Out of Arbitration

You may opt out of arbitration by sending written notice to info@lysaratech.com within 30 days of first using OneVine. Your notice must include:

• Your name and email address
• A clear statement that you wish to opt out of arbitration

If you opt out, disputes will be resolved in court.

13.5 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OneVine regarding your use of the App.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or successor without restriction.

14.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including:

• Natural disasters
• War or terrorism
• Government actions
• Internet or telecommunications failures
• Third-party service outages

14.6 No Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and OneVine.

14.7 Headings

Section headings are for convenience only and do not affect interpretation of these Terms.

15. Changes to OneVine

We reserve the right to:

• Modify or discontinue any feature of OneVine at any time
• Change pricing for subscriptions and purchases (with notice)
• Update the App with new features or improvements
• Temporarily suspend OneVine for maintenance

We will provide reasonable notice of material changes when possible.

16. Export Control

You agree to comply with all applicable export and import laws and regulations. You represent that you are not:

• Located in a country subject to a U.S. government embargo
• Listed on any U.S. government list of prohibited or restricted parties

17. Mobile Application Terms

17.1 App Stores

If you download OneVine from an app store (Apple App Store, Google Play):

• These Terms are between you and OneVine, not the app store provider
• The app store provider has no obligation to provide support
• You must comply with the app store's terms of service
• The app store provider is a third-party beneficiary of these Terms

17.2 Mobile Carrier

Your mobile carrier's data and messaging rates may apply. You are responsible for all carrier charges.

17.3 Updates

We may release updates to OneVine. You may need to update the App to continue using it. Updates may modify or remove features.

18. Accessibility

We strive to make OneVine accessible to all users. If you encounter accessibility barriers, please contact us at info@lysaratech.com.

19. Notice for California Residents

Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice:

If you do not agree to these Terms, you must stop using OneVine immediately and delete the App from your device.
